Personal data protection
Adverticum Zrt. respects and protects the personal data of all those who come into contact with us, whether via the web or via publications.
27. 02. 2007.
It is generally possible for anyone to browse on the Prim Online website without first having to provide personal information. It also possible, however, that on occasion we will require information about you, for example your name or email address. In such cases, however, our intention is to inform you beforehand of the reasons for requesting this information and it will only be used for the stated purposes. Such instances would include, for example, publication subscriptions or the ordering of electronic newsletters. If you do not give us permission to contact you at a later date based on the data received from you, we will respect this decision.
We apply the following basic principles during our operations:
- It is generally possible for anyone to browse on the Prím-online website without first having to provide personal information.
- Some services require the provision of individual identification and personal data and it is also possible that service providers may ask for data in order to provide a better service to readers and visitors. Each person decides on the provision of such data on their own responsibility and we ask that anyone who does not feel the data protection listed below to be adequate should not provide this data – even if it means giving up the opportunity to use a service.
- Prím Online’s operator may request data that is not necessarily required for the use of the service, the provision of which is optional. In such cases the service provider will clearly state the reason for requesting the data and the answers will only be used for the stated purposes. (Such instances would include, for example, publication subscriptions or the ordering of electronic newsletters.) If the data-supplier, while providing the information does not give the service provider permission to contact them at a later date based on the data received, the service provider will respect this decision.
- Prím Online’s operator respects and protects the personal data of all those who come into contact with us, whether via the web or via publications. Any personal data howsoever received which the owner did not intentionally provide, will not be stored or passed on by the service provider, except in the case specified in the following point.
- In the case of a crime, or serious suspicion of such, the service provider has a duty to cooperate with the investigating authorities. In the case of a police or judicial decision requiring the securing of data, the service provider is obliged to allow the specified data to be viewed or to make such data available as is covered by the ruling and is to be found on the service provider’s servers. In such situations the service provider can only protect the data on their servers within the limits of the relevant laws and the data-suppliers must be aware that this data may come into the possession of the investigating authorities.
- Personal data intentionally provided to Prím Online will only be used by the service provider for the purpose for which it was provided. (Subscribers’ addresses, for example, will only be used for deliveries or billing, readers’ questionnaires only for statistics in accumulated form or individually for possible lottery draws, etc.) This data will not be passed on by the service provider for any alternate uses to any third parties under any circumstances – with the exception of the circumstances described in the previous point
- Prím Online’s operator will only make public partner, subscriber or audience data in a processed format that cannot be connected to any individual identification and will not, within these statistics, deal with subject matter that in any way goes beyond questions of public interest connected to the publications’ readership.
- Personal data stored by the operator will be protected by the service provider, using all available methods, from coming into the possession of unauthorised hands either in part or in whole. At the same time if this data is acquired by someone through criminal activity, the service provider will not be held liable for any resulting damage.
- Automatically generated information is collected on visitors to Prím Online: the visitor’s IP address, domain name, time of visit, pages viewed, browser used. However, the service provider processes this data purely for analytical purposes to follow trends and statistical information, and following statistical processing the operator destroys the individual data.
- The Prím Online website contains links to other websites. Prím Online’s operator is not responsible for the personal data policies or content of these websites.
Other legal, ethical, liability and security questions:
- Individuals using Prím Online’s services accept that they may not use the free services to further or facilitate economic activities, nor for continuous business acquisition or its facilitation. They also accept that in order to cover the costs associated with operating free services, advertisements may appear on the services’ webpages or via mail.
- The Prím Publishing House, via its services, secures the opportunity for its users to express their opinions and does not censor comments appearing on the forum, messages sent via the free Prímposta mailing system, or webpage or file system contents placed on the server. Prím Online’s operator accepts no responsibility for these opinions and is not in a position to restrict them in regards to the mailing list and folder system. In the case of disputed issues, we advise plaintiffs to directly address the party making the disputed statements.
- If Prím Online’s operator finds that its services are demonstrably being used for illegal activities, or if the written or unwritten ethical rules of the internet are being broken, then the operator shall delete the given address, list, folder or content and may exclude the given user from the service. The service provider cannot take on the task of proving a case, therefore the reprisals listed above will be utilised, within its own remit, only in instances of generally accepted and obvious legal or Netiquette abuses (use of prohibited symbols, insults directed at minorities or denominations, incitement to criminal activity, etc.). In the case of disputed or disputable cases awaiting proof and legal disputes between two or more natural and/or legal entities, Prím Online’s operator will act on a legally binding police or judicial decision requiring the securing of data, according to the terms of the official document.
- We do not accept responsibility for lists created in the PrimLista system; it is not in our power to examine the messages sent to the lists. Those lists which contain the addresses of other lists and whose operation contravenes Law CVIII. (2001), will be deleted without further warning.
- Based on many years of experience, the Prímlista mailing services of Prímposta operate with the same level of security as similar business services, however, the service provider does not accept any responsibility for delayed or missing mail, in part due to the fact that these are not business-oriented services and in part because of the uncertainties resulting from the internet’s architecture. We advice users to check on the receipt of all important mail (rsvp request, via telephone) and to repeat the send if it has not arrived on time.
- Prím Online’s operator does not accept responsibility for computer viruses contracted by service users. This type of responsibility cannot be accepted even in the case of services which are protected by virus protection software as the distributors of the virus protection software also disclaim all such responsibility.
- Prím Online’s servers cannot be viewed as a storage or archive facility for dormant data, therefore any unnecessary, unused data will be deleted by the operator. The system regards as unnecessary any data that is untouched by its creator for a period of three months. Prím Online’s operator will warn any user - via the mail address they provided - who has placed data on the Prím Online system servers (has sent messages, has opened folders or a Prím list, has created a webpage), but has not used the system’s services or accessed their data for a period of three months. If the user responds to the warning by entering the service, the system assumes that the data is still required and the three month period starts again. (We wish to emphasis that Prím Online’s operator does not accept any responsibility for the warning reaching the user.)
- The operator retains data, messages, webpages and archives placed on Prím Online’s servers to the best of their ability and in keeping with the appropriate level of care (and within the time limits set out in the previous point). However, the operator does not accept liability for any damage in the event of temporary unavailability or permanent destruction - whether caused by harmful human intent, an informatics (hardware-software) failure, or as a result of infection by a virus. We ask all visiting users of Prím Online services to make and store backup copies of any data, the loss of which would cause them irreplaceable loss, on their own machines, their own storage device or data carrier. They should do this irrespective of the fact that Prím Online’s operator also continuously produces backup copies and seeks to moderate any losses caused by possible failure and to restore the data, using all possible means.
